Legal Consultation Service

Scope of Legal Consultation Service

Legal consultation services are provided to AAMFT Clinical Fellows, Pre-Clinical Fellows, Members, and Associate Members in legal matters relating to their professional practice of marriage and family therapy. The service includes telephone consultation with the member, but does not include representation of the member to third parties. As with any legal issue, members are also encouraged to consult with a local attorney. To best serve members, the attorney will not be able to provide:

Research
Advice pertaining to individual state law. For interpretation of state or provincial law, members are encouraged to contact an attorney licensed in their respective state or province.

Representation of the member before any court or administrative body, or any negotiation, arbitration or dispute process. If the member has purchased coverage under the AAMFT professional liability insurance program, through CPH and Associates, the member may receive reimbursement up to $5,000.00 for certain counsel fees and expenses. Refer to liability insurance plan documents for more information.

Consultation to the member in any matter not related to the member's practice of marriage and family therapy. The Plan does not cover matters of dispute between a member and the AAMFT or another member.

SPECIAL NOTE: Members utilizing the legal consultation service should be aware that the attorney, employed by the AAMFT, represents the AAMFT in all matters. If a member is the subject of an ethics complaint before the AAMFT Ethics or Judicial Committees, or if the member is involved in any other dispute with the AAMFT, the attorney will cease any legal consultation with said member and provide all necessary and appropriate representation to the AAMFT concerning such a matter. The AAMFT’s Family Therapy Magazine has featured many articles over the years on legal and ethical issues that Marriage and Family Therapists frequently encounter. Written by AAMFT members and staff, these FTM articles provide valuable information on dealing with the major legal issues and ethical concerns faced by therapists.
